A new procedure – express for the issuance of the certificate of non-debt Real Estate Fee (TAP), which is necessary for the transfer of real estate, is established by the Ministry of Interior.
The certificate will be issued within three days and will be valid for one year from its issuance, while alternative ways of issuing the certificate are established in case of inability to issue the TAP certificate within three days. This is a move that is expected to remove a significant obstacle to the completion of real estate sales and will speed up the process.
In particular, a new provision included in the anti-corruption bill stipulates that in case of transfer of ownership of all types of real estate for any reason and before the signing of the contract, a certificate of non-debt of Real Estate Fee (TAP) is required, otherwise the notarial deed is invalid and does not induce any legal consequence. The certificate is sought ex officio by the notary or presented by the seller, is issued within three days based on the data kept electronically by the municipality and is valid for one year from its issuance.
